    1.    Introduction and Acceptance of Terms

    1.1.  These Terms and Conditions ("Terms") govern your use of the facilities, services, and amenities provided by Soak House ("we", "us", or "our") located at Canterbury Rugby Club, Merton Lane North, Canterbury, Kent ("the Premises"). By making a booking, purchasing a session, attending as a guest of a booking holder, or otherwise using the Premises and facilities, you agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you are prohibited from the use of our facilities or services.

    1.2.  These Terms constitute a legally binding agreement between you ("you", "your", the "Participant", or the "Customer") and Soak House. We recommend that you read these Terms carefully before each visit, as they may be updated from time to time in accordance with Clause 16.6. The version of these Terms applicable to your session is the version published on our website at the time of your booking. ‍

    1.3.  Where you are booking on behalf of a group, you confirm that you have the authority to accept these Terms on behalf of all group members, and you shall ensure that every member of your group reads, understands, and complies with these Terms before entering the Premises.

    2.    Definitions and Interpretation

    2.1.  In these Terms, unless the context otherwise requires, the following expressions shall have the meanings ascribed to them below:

    "Booking"

    means any reservation, appointment, or purchase made by you or on your behalf for access to the Facilities, whether made via our website, by telephone, by email, or in person.

    "Customer" or "Participant"

    means any person who makes a Booking, uses the Facilities, or is present on the Premises, including guests and invitees of a booking holder.

    "Facilities"

    means the sauna (wood-fired), ice baths, cold plunges, outdoor showers, ambient plunge, fire pit, seating areas, and any other amenities made available by Soak House at the Premises.

    “Founders Membership”

    means the Soak House membership tier for the initial club members.

    "Host Venue" or "Rugby Club"

    means Canterbury Rugby Club, the owner and operator of the land and premises on which Soak House operates.

    "Premises"

    means the physical area at Canterbury Rugby Club, Merton Lane North, Canterbury, Kent, in which Soak House operates, including the immediate outdoor area surrounding the Facilities.

    "Session"

    means a single booked period of access to the Facilities, comprising approximately fifty (50) minutes of active use time plus ten (10) minutes for changing, totalling one (1) hour per slot.

    “Soak House”

    means Soak House Ltd a private company limited by shares registered in England and Wales with company number 16542464 with its registered office at 2 High Street, Aylesford, Kent, ME20 7BG;

    "Waiver"

    means the Soak House Waiver, Release and Assumption of Risk document, which must be completed and signed prior to using the Facilities.

    2.2.  References to "including" or similar expressions shall be construed as meaning "including without limitation". Headings are for convenience only and shall not affect the interpretation of these Terms.

    3.    Information About Us

    3.1.  Soak House is a wellness business operating from Canterbury Rugby Club, Merton Lane North, Canterbury, Kent, United Kingdom. Our primary business is the provision of contrast therapy facilities, including wood-fired sauna sessions, ice baths, cold plunges, and associated wellness amenities.

    3.2.  We may be contacted by email at hello@soakhouse.co.uk, or via our website at www.soakhouse.co.uk. All formal notices and communications relating to these Terms should be directed to the aforementioned email address unless otherwise specified in writing.

    4.    Description of Facilities and Services

    4.1.  Soak House provides access to outdoor wellness facilities, which at present include, but are not limited to, the following: a wood-fired sauna, four (4) ice baths and cold plunge pools maintained at varying temperatures, two (2) outdoor showers, an ambient plunge pool, a fire pit, and a designated seating and relaxation area. The specific Facilities available during any given Session may vary depending on maintenance schedules, weather conditions, operational requirements, or other factors beyond our reasonable control.

    4.2.  Each Session provides approximately fifty (50) minutes of active facility use, followed by a ten (10) minute changeover period, totalling one (1) hour. The maximum capacity per Session is limited to ten to twelve (10–12) persons to ensure a safe, comfortable, and enjoyable experience. We reserve the right to adjust the available Facilities, capacity, or session duration at any time, provided that any material changes shall be communicated to you in advance of your Session where reasonably practicable.

    4.3.  Our services are provided for recreational and general wellness purposes only. Nothing in these Terms, or in any communication by our staff, shall be construed as medical advice, a recommendation for treatment, or a guarantee of any specific health outcome. You are solely responsible for determining whether use of the Facilities is appropriate for your individual health circumstances.

    5.    Booking and Reservation

    5.1.  Bookings may be made through our website at www.soakhouse.co.uk, by telephone, by email, or in person, subject to availability. All Bookings are subject to these Terms and to the completion of the Waiver prior to participation. A Booking is not confirmed until full payment has been received and a confirmation has been issued to you by Soak House. We reserve the right to refuse or cancel any Booking at our sole discretion.

    5.2.  When making a Booking, you must provide accurate and complete information, including your full name, contact email address, and telephone number. Where you are booking on behalf of a group, you are responsible for ensuring that all group members provide accurate information and complete the required Waiver before the Session. Failure to provide accurate information may result in the refusal of admission without a refund.

    5.3.  You must arrive on time for your Session. If you arrive late, your Session time shall be reduced accordingly, and the full fee shall remain payable. We operate a strict changeover between Sessions and cannot extend your time to accommodate late arrivals. If you arrive more than fifteen (15) minutes after the scheduled start time, we reserve the right to refuse admission, in which case no refund shall be provided.

    6.    Pricing and Payment

    6.1.  All prices are displayed in British Pounds Sterling (£) and include applicable taxes at the prevailing rate. Prices are subject to change at any time, but any change shall not affect Bookings that have already been confirmed and paid for in full. Payment must be made in full at the time of Booking, unless alternative arrangements have been agreed in writing by Soak House.

    6.2.  We accept payment by debit card, credit card, and such other methods as may be advertised on our website from time to time. Payment processing is carried out by a third-party payment service provider, and your payment card details are processed in accordance with the Payment Card Industry Data Security Standard (PCI DSS). Soak House does not store your full payment card details on its own systems.

    6.3.  For membership arrangements, including the Founders Membership, separate membership terms and conditions shall apply, which are incorporated into these Terms by reference. Membership fees are collected by Direct Debit, and the membership terms govern the specific payment obligations, cancellation requirements, and other membership-related provisions.

    7.    Cancellation and Refund Policy

    7.1.  Our cancellation and refund policy is as follows, and you are advised to review it carefully before making a Booking:

    7.1.1.     Private Bookings:

    A full refund, less a 2.5% card processing fee, shall be provided if you cancel your Booking more than twenty-four (24) hours before the scheduled start time of your Session. Cancellations made within twenty-four (24) hours of the scheduled start time shall not be entitled to a refund. Refunds, where applicable, shall be processed within three (3) to five (5) working days and returned to the original payment method.

    7.1.2.     Social Sessions and Events:

    Bookings for social sessions and events are non-refundable. However, you may request to reschedule your Session to a later date, provided that notice is given more than twenty-four (24) hours before the scheduled start time. Each Booking may be rescheduled once only, subject to availability. No rescheduling is permitted within twenty-four (24) hours of the Session.

    7.1.3.     Special Occasion and Large-Group Bookings:

    For special occasion bookings and large-group bookings, a full refund, less a 2.5% card processing fee, shall be provided if cancelled more than two (2) weeks before the scheduled Session. Cancellations made within two (2) weeks of the Session are non-refundable but may, at our sole discretion, be rescheduled by mutual agreement.

    7.1.4.     Membership Cancellations:

    7.1.4.1. Membership cancellation is governed by the applicable membership terms and conditions. The Founders Membership, for example, requires a minimum of two (2) calendar months' written notice and is subject to specific cancellation fees as set out in the membership agreement.

    7.1.4.2. In exceptional circumstances, such as serious illness or family emergency, we may consider refund requests on a case-by-case basis. Such requests must be submitted in writing to hello@soakhouse.co.uk as soon as reasonably practicable, and we reserve the right to request supporting documentation. Our decision in such cases shall be final.

    8.    Session Structure and Capacity

    Each Session operates on a structured timetable. The active use period is approximately fifty (50) minutes, followed by a ten (10) minute changeover period during which all Participants must vacate the Facilities to allow preparation for the next group. The maximum number of Participants permitted per Session is ten to twelve (10–12) persons. This capacity limit is set to ensure the safety, comfort, and enjoyment of all Participants and must not be exceeded.

    Soak House staff shall signal the end of the active use period, and all Participants must comply promptly with instructions to leave the Facilities. Failure to vacate the Facilities on time may result in the imposition of reasonable charges or, in persistent cases, the suspension of future booking privileges. We do not guarantee access to any specific Facility during your Session; access is on a first-come, first-served basis within the booked group.

    9.    Admission and Right of Refusal

    9.1.  We reserve the right to refuse admission to, or to require the departure of, any person from the Premises at any time, including but not limited to the following circumstances: where a person appears to be under the influence of alcohol, drugs, or any other intoxicating substance; where a person fails or refuses to complete the required Waiver; where a person fails to comply with these Terms or any reasonable instruction given by Soak House staff; where a person's behaviour poses a health and safety risk to themselves or others; or where a person is visibly unwell or otherwise unfit to use the Facilities.

    9.2.  We may refuse entry to, or require the departure of, any participant who appears to be suffering from a communicable illness or whose continued participation would present a health and safety risk.

    9.3.  Persons who are refused admission or required to leave the Premises under this Clause shall not be entitled to a refund of any fees paid. We reserve the right to impose temporary or permanent bans on any individual whose conduct, in our reasonable opinion, is unacceptable, dangerous, or incompatible with the safe and enjoyable operation of the Facilities.

    10.         Age Restrictions and Minors

    10.1.       No person under the age of eighteen (18) years is permitted to enter or use the Facilities, unless they are accompanied at all times by their parent, legal guardian, or a responsible adult designated by their parent or legal guardian ("Responsible Adult"). The Responsible Adult must remain on the Premises and maintain direct supervision of the minor for the entire duration of the Session. For the purposes of this Clause, a "Responsible Adult" means a person aged eighteen (18) years or over who has been expressly authorised by the minor's parent or legal guardian to supervise the minor during the Session.

    10.2.       Where a minor is admitted under this Clause, the accompanying Responsible Adult must complete and sign the Waiver on behalf of the minor, accept full responsibility for the minor's safety and conduct, and ensure that the minor complies with all applicable rules and instructions. The Responsible Adult acknowledges and agrees that they are personally responsible for any risks, injuries, or damages arising from the minor's use of the Facilities, and they indemnify Soak House and the Released Parties (as defined in the Waiver) accordingly.

    10.3.       No person under the age of sixteen (16) is permitted to use ice baths, cold plunges, or any water maintained at or below fifteen degrees Celsius (15°C), regardless of parental supervision. This restriction is absolute and is implemented on health and safety grounds. Soak House reserves the right to request proof of age at any time, and admission may be refused where such proof is not provided.

    11.         Health and Safety — Your Obligations

    11.1.       Before using the Facilities, you must complete and sign the Waiver, which includes a medical declaration. It is your responsibility to ensure that the information you provide in the Waiver is accurate, complete, and up to date.

    11.2.       If your health status changes between Sessions, you must inform Soak House before your next visit.

    11.3.       You must not use the Facilities if any of the following apply to you (this list is non-exhaustive): pregnancy; recent heart attack, stroke, or cardiovascular event; uncontrolled high or low blood pressure; known cardiovascular disease; arterial disease; epilepsy or seizure disorders (persons with epilepsy are prohibited from using the Facilities without exception); asthma or other respiratory conditions that may be exacerbated by heat or cold exposure; joint or muscle injuries; or any other condition that a medical professional has advised may be aggravated by heat or cold exposure therapy.

    11.4.       We reserve the right to require written confirmation from a suitably qualified medical professional that you are fit to use the Facilities. We may refuse participation until such confirmation is received.

    11.5.       In the event of illness, injury or medical emergency, you authorise Soak House to contact emergency services, contact your nominated emergency contact and disclose relevant medical information where reasonably necessary to protect your health and safety.

    12.         Limitation of Liability

    12.1.       Subject to the provisions of this Clause 12, and to the extent permitted by applicable law, Soak House, its owners, directors, employees, agents, contractors, and affiliates (collectively, the "Released Parties") shall not be liable for any loss, damage, injury, or expense (including but not limited to personal injury, death, property damage, or economic loss) arising out of or in connection with your use of or presence on the Premises, except to the extent that such liability cannot be lawfully excluded or limited.

    12.2.       Nothing in these Terms shall exclude or limit the liability of the Released Parties: (a) for death or personal injury caused by their negligence; (b) for fraud or fraudulent misrepresentation; or (c) for any other liability that cannot be excluded or limited by applicable English law. These exclusions reflect the mandatory protections afforded to consumers under the Unfair Contract Terms Act 1977, the Consumer Rights Act 2015, and any other applicable legislation.

    12.3.       To the fullest extent permitted by applicable law, and subject to the mandatory exceptions set out above, the Released Parties' total aggregate liability to you in respect of any and all claims arising out of or in connection with these Terms or your use of the Premises, whether in contract, tort (including negligence), statutory duty, or otherwise, shall not exceed the total amount of fees paid by you to Soak House in respect of the specific Session or membership period giving rise to the claim.

    12.4.       The Released Parties shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or anticipated savings, regardless of whether such damages were foreseeable or whether the Released Parties were advised of the possibility of such damages. This limitation applies regardless of the legal theory on which the claim is based.

    12.5.       You acknowledge that the use of the Facilities involves inherent risks, and you voluntarily assume all such risks to the fullest extent permitted by law. You are advised to obtain appropriate personal insurance cover if you consider it necessary.

    13.         Boundary of Responsibility — Host Venue

    Soak House operates from premises owned and managed by the Host Venue (Canterbury Rugby Club). We are responsible only for areas under our operational control. The Host Venue is a separate and independent legal entity, and Soak House is not responsible for any areas outside the designated Soak House operating area. This includes, but is not limited to, the car park, access roads, pathways, playing fields, and any other areas of the Rugby Club's premises that are not part of the Soak House Facilities.

    14.         Intellectual Property

    All intellectual property rights in and relating to the Soak House brand, name, logo, website, marketing materials, signage, and any other content, materials, or designs created by or on behalf of Soak House (collectively, "IP Materials"). No licence or right is granted to you under these Terms to use, reproduce, distribute, modify, or exploit any IP Materials for commercial purposes without the prior written consent of Soak House.

    15.         Photography, CCTV and Recording

    Details of how we process photographic data are contained within our Privacy Policy. If you do not wish to be photographed or recorded for Soak House’s marketing purposes you must indicate your photography preferences in the Waiver.

    16.         General Provisions

    16.1.      Governing Law and Jurisdiction

    These Terms shall be governed by and construed in accordance with the laws of England and Wales. You irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms, their subject matter, or their formation (including non-contractual disputes or claims).

    16.2.      Entire Agreement

    These Terms, together with the Waiver, the Privacy Policy, and any applicable membership terms, constitute the entire agreement between you and Soak House in relation to the use of the Facilities and supersede all prior representations, warranties, understandings, negotiations, and agreements between the parties, whether written or oral, relating to their subject matter. You acknowledge that you have not relied on any statement, representation, or assurance other than those expressly set out in these Terms.

    16.3.      Waiver

    No failure or delay by Soak House in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right, power, or remedy. No single or partial exercise of any right, power, or remedy shall preclude any other or further exercise of that or any other right, power, or remedy. Any waiver of a breach of these Terms shall not be deemed a waiver of any subsequent breach.

    16.4.      Force Majeure

    Soak House shall not be liable for any delay or failure in the performance of its obligations for so long as and to the extent that such delay or failure results from events, circumstances or causes beyond its reasonable control (“Force Majeure Event”). For any Force Majeure Event, affected Customers may either reschedule their Session to a later date or receive a full refund in respect of that Session.

    16.5.      Third-Party Rights

    Except as expressly provided in these Terms, no person who is not a party to these Terms shall have any right to enforce any term of these Terms under the Contracts (Rights of Third Parties) Act 1999.

    16.6.      Amendments to These Terms

    Soak House reserves the right to amend or update these Terms at any time. Any material changes shall be communicated by posting the updated Terms on our website and, where reasonably practicable, by notifying Customers via email. The updated Terms shall take effect from the date specified on the revised document (the "Revised Effective Date"). Bookings made after the Revised Effective Date shall be subject to the updated Terms. For Bookings made before the Revised Effective Date, the Terms in effect at the time of Booking shall apply to that specific Session.

    16.7.      Consumer Rights

    Nothing in these Terms shall affect your statutory rights as a consumer under the Consumer Rights Act 2015, the Consumer Protection from Unfair Trading Regulations 2008, or any other applicable consumer protection legislation.

    16.8.      Survival

    The provisions of these Terms which are intended to survive termination or expiry, including those relating to liability, indemnities, intellectual property, dispute resolution and governing law, shall continue in full force and effect following the completion of any Session or termination of any Booking or Membership.

    1.    Introduction

    Payment Data:

    your payment card details (processed directly by our third-party payment provider; we do not store full card numbers), billing address, and transaction records.

    Emergency Contact Data:

    the name and telephone number of your nominated emergency contact.

    Health and Medical Data (Special Category Data):

    information about your health conditions, medical history, medications, and fitness to participate.

    CCTV and Photographic Data:

    CCTV footage captured on the Premises for security and safety purposes, and any photographs or video recordings taken for promotional or marketing purposes with your consent.

    Website Usage Data:

    information about how you use our website, including your IP address, browser type, device information, pages visited, and time spent on the site.

    5.    How We Collect Your Data

    We collect Personal Data through the following channels and methods:

    Directly from you when you make a booking through our website, by telephone, or by email.

    From the Waiver and medical declaration form, which you complete and sign before using the Facilities.

    From membership application and enrolment forms, including the Founders Membership form.

    From correspondence and communications with you, including emails, telephone calls, and in-person conversations.

    Automatically through our website using cookies, analytics, and similar technologies, as described in Clause 14.

    Through CCTV cameras operating on the Premises for security and safety purposes.

    Through photographs and video recordings taken on the Premises for promotional or marketing purposes, where consent has been obtained.

    We will only collect Personal Data that is necessary for the specific purposes described in this Privacy Policy, and we will not collect excessive data in relation to those purposes.

    6.    How and Why we use your Personal Data

    Under data protection law, we can only use your Personal Data if we have a proper reason, e.g.:

    The health and medical information you disclose in the Waiver and medical declaration constitutes Special Category Data under Article 9 of the UK GDPR. The processing of Special Category Data is subject to additional protections and restrictions under the law. We collect and process this data for the following reasons:

    • To assess your fitness and suitability to use the Facilities safely, and to identify any contraindications or health risks associated with sauna use, cold exposure, and other activities.

    • To ensure the safety of you and other Participants, and to enable our staff to respond appropriately in the event of a medical emergency.

    • To comply with our health and safety obligations under the Health and Safety at Work etc. Act 1974 and related legislation.

    Where we process Special Category Data, we will also ensure we are permitted to do so under data protection laws, eg:

    • We rely on your explicit consent as the legal basis for processing your Special Category Data;

    • the processing is necessary to protect your (or someone else’s) vital interests in health and safety.

    You may withdraw your consent at any time by contacting us at hello@soakhouse.co.uk; however, if you withdraw consent for the processing of health data, we may be unable to permit you to use the Facilities, as we would not be able to assess your safety.

    8.    Direct Marketing and Communications

    We may send you marketing communications by email or SMS regarding our services, special offers, events, and promotions. We will only send such communications where you have given us your explicit consent to do so. Where you provide your email address or telephone number for booking purposes, we will not automatically add you to marketing mailing lists; a separate opt-in consent will be sought.

    You may opt out of receiving marketing communications at any time by:

    • clicking the unsubscribe link in any marketing email we send you;

    • texting STOP to any SMS marketing message you receive from us;

    • or contacting us directly at hello@soakhouse.co.uk.

    Please note that even if you opt out of marketing communications, we may still send you service-related messages (such as booking confirmations, session reminders, or safety notices) that are necessary for the performance of our contract with you.

    We will always treat your Personal Data with the utmost respect and never sell OR share it with other organisations for marketing purposes.

    10. Data Sharing With Third Parties

    We do not sell, rent, or trade your Personal Data to any third party. We may share your Personal Data with the following categories of third parties, only for the purposes described in this Privacy Policy and where a lawful basis exists:

    Host Venue (Canterbury Rugby Club):

    We may share your name and booking details with the Rugby Club in connection with the operation of the Facilities on their premises, for access and security purposes.

    Payment Service Providers:

    We share your name, card details (via secure tokenisation), and transaction data with our payment processor to facilitate online payments. Our payment provider is PCI DSS compliant. When you enter your payment card details, this information is transmitted directly to the payment processor via a secure, encrypted connection. Soak House does not store your full payment card number, card verification value (CVV), or expiry date on its systems. We retain only a record of the transaction amount, date, and the last four digits of your card number for our own records and accounting purposes.

    Insurance Providers:

    We may share relevant Personal Data and Waiver forms with our insurers in connection with any insurance claim, risk assessment, or policy renewal.

    Professional Advisors:

    We may share Personal Data with our accountants, solicitors, or other professional advisors where necessary for the provision of professional services to us.

    Emergency Services:

    In the event of a medical emergency on the Premises, we may disclose relevant Personal Data (including health information and emergency contact details) to ambulance services, hospital staff, or other emergency responders.

    Law Enforcement and Regulatory Authorities:

    We may disclose Personal Data if required to do so by law, by court order, or by any applicable regulatory authority, including the Information Commissioner’s Office (ICO).

    9.    Data Transfers Outside the UK

    Your Personal Data is primarily stored and processed within the United Kingdom.     Booking and customer records:

    retained for a period of six (6) years from the date of your last interaction with us, for tax, accounting, and legal purposes.

    Signed Waivers and medical declarations:

    retained for a minimum of six (6) years from the date of signing, or longer if required in connection with any legal proceedings, insurance claim, or regulatory investigation.

    Payment and transaction records:

    retained for six (6) years from the date of the transaction, in accordance with tax and accounting requirements.

    CCTV footage:

    retained for a maximum of thirty (30) days, unless retained for longer in connection with a specific incident, investigation, or legal proceeding.

    Marketing consent records:

    retained for as long as you remain opted in to marketing communications, plus a reasonable period thereafter to evidence your consent.

    Membership records:

    retained for the duration of your membership plus six (6) years following the termination or cancellation of your membership.

    When Personal Data is no longer required, it shall be securely deleted or anonymised in accordance with our data retention procedures.

    12.         Exercising Your Rights

    To exercise any of the rights described in Clause 11, please submit a written request to us at hello@soakhouse.co.uk. We will acknowledge your request within five (5) working days and will respond substantively within one (1) calendar month, or within three (3) months in complex cases (in which case we will notify you of the extension and the reasons for it). We may ask you to verify your identity before processing your request, to ensure that Personal Data is not disclosed to an unauthorised person.

    We will not charge you a fee for exercising your rights, except where a request is manifestly unfounded, excessive, or repetitive, in which case we may charge a reasonable administrative fee or refuse to act on the request. If we refuse a request, we will explain the reasons for our decision and inform you of your right to complain to the Information Commissioner’s Office (ICO).

    13.         Children and Minors’ Data

    We do not knowingly collect Personal Data from children under the age of thirteen (13) through our website or online booking system. Where a minor aged thirteen (13) to seventeen (17) uses our Facilities, their Personal Data will be collected and processed with the knowledge and consent of their parent or legal guardian. The parent or legal guardian who accompanies the minor is responsible for ensuring that the minor’s data is provided accurately and that the Waiver is completed on the minor’s behalf.

    In accordance with our Terms and Conditions, no person under the age of eighteen (18) may use the Facilities unless accompanied by a parent, legal guardian, or responsible adult aged eighteen (18) years or over expressly authorised by the minor's parent or legal guardian to supervise the minor during the Session ("Responsible Adult"). Personal Data relating to minors is treated with particular care and is retained only for as long as necessary for the purposes described in this Privacy Policy.

    15.         CCTV and Security Recording

    Soak House operates CCTV cameras on the Premises for the purposes of maintaining security, ensuring the safety of Participants and staff, preventing and detecting crime, and investigating any incidents that may occur. CCTV cameras are positioned in outdoor and communal areas of the Premises and will not be directed at areas where there is a reasonable expectation of privacy, such as inside changing areas, showers, or the sauna.

    CCTV footage is recorded in a digital format and is stored securely. Footage is retained for a maximum of thirty (30) days, after which it is automatically overwritten or securely deleted, unless it has been flagged for retention in connection with a specific incident, investigation, or legal proceeding. Access to CCTV footage is restricted to authorised Soak House personnel and, where necessary, to law enforcement authorities.

    You have the right to request access to CCTV footage that features you, subject to the rights of other individuals who may also appear in the footage. Requests for access to CCTV footage should be directed to hello@soakhouse.co.uk.

    16.         Photography and Marketing Consent

    Soak House or its representatives may, from time to time, take photographs or record video footage on the Premises for promotional, marketing, or operational purposes. Where such photography or recording may feature identifiable images of Participants, we will seek your consent before using such images for marketing purposes. You may provide or withhold consent at the time of your Session or by contacting us in advance at hello@soakhouse.co.uk.

    If you consent to being photographed or recorded, you may withdraw your consent at any time by notifying us in writing. Upon withdrawal of consent, we will cease using your image in future marketing materials as soon as reasonably practicable, although we may not be able to remove images that have already been published or distributed. The Waiver form includes a section addressing photography consent, and your responses on that form will govern the use of your image.

    17.         Data Security Measures

    We take appropriate technical and organisational measures to protect your Personal Data against unauthorised access, alteration, disclosure, or destruction. These measures include: storing Personal Data on secure, password-protected systems; using SSL/TLS encryption for data transmitted through our website; restricting access to Personal Data to authorised personnel only; regularly reviewing and updating our security practices; and ensuring that any third-party service providers with access to Personal Data maintain appropriate security standards.

    Despite our best efforts, no method of transmission over the Internet or electronic storage is completely secure. We cannot guarantee the absolute security of your Personal Data.   • 1.    Sauna Rules and Warnings

    1.1.  The sauna is a wood-fired facility and operates at elevated temperatures. By using the sauna, you acknowledge and accept the associated risks, including but not limited to heat-related illness, dehydration, burns, exacerbation of underlying medical conditions, and cardiovascular stress. You must adhere to the following rules at all times:

    1.1.1.     Do not touch the stove, stove door, flue, chimney, sauna rocks, or fire guards. These surfaces become extremely hot and may cause severe burns. Injuries resulting from contact with these elements are the sole responsibility of the individual.

    1.1.2.     Water may only be poured onto the sauna stones as instructed by Soak House staff. When pouring water, you must do so from the point furthest from you, reaching across the sauna, to avoid steam burns. Do not throw water onto the stones.

    1.1.3.     Limit your time in the sauna to durations recommended by staff, and take regular breaks to cool down. Exit the sauna immediately if you feel unwell, dizzy, or excessively uncomfortable.

    1.1.4.     Do not apply essential oils, skincare products, or any other substances to the sauna stones or interior surfaces unless expressly permitted by Soak House staff.

    1.1.5.     Remove all hanging jewellery before entering the sauna, as metal jewellery can conduct heat and cause burns.

    1.1.6.     Always sit on a towel inside the sauna. Do not place towels or any other items on the sauna heater.

    2.    Ice Bath and Cold Plunge Rules and Warnings

    2.1.  The use of ice baths and cold plunges involves significant inherent risks, including cold shock response, hypothermia, cardiovascular stress, exacerbation of underlying medical conditions, and in extreme cases, drowning. By using these Facilities, you acknowledge and accept these risks. You must adhere to the following rules:

    2.1.1.     Cold plunge and ice bath use is at your own risk. Ensure that you understand the risks of cold exposure before entering the water.

    2.1.2.     Limit your exposure to short, controlled durations as recommended by Soak House staff or in accordance with guidance provided during your Session. Do not exceed recommended immersion times.

    2.1.3.     Exit the water immediately if you experience any adverse symptoms, including but not limited to gasping, uncontrollable shivering, confusion, numbness, chest pain, difficulty breathing, or dizziness.

    2.1.4.     Persons who are pregnant, or who have a history of heart conditions, cardiovascular disease, Raynaud's disease, or cold urticaria, must consult a doctor before using cold exposure Facilities and must provide written medical clearance if requested by Soak House.

    2.1.5.     No person under the age of sixteen (16) may use water maintained at or below fifteen degrees Celsius (15°C), regardless of supervision.

    2.1.6.     Enter and exit the ice baths and cold plunges slowly and with caution, as surfaces around the Facilities may be slippery.

    3.    Fire Pit Rules and Warnings

    3.1.  A fire pit is available for use on the Premises, subject to the following rules. The fire pit may only be used in accordance with staff guidance and any posted safety instructions. You must not leave the fire pit unattended while it is lit. No accelerants, personal items, rubbish, or any unauthorised materials may be placed in or near the fire pit. Unsafe behaviour around the fire pit, including running, pushing, or horseplay, is strictly prohibited.

    3.2.  Children under the age of sixteen (16) must be supervised at all times by a Responsible Adult when in the vicinity of the fire pit. Use of the fire pit while intoxicated or impaired is strictly prohibited. Users accept all risks associated with fire pit use, including but not limited to burns, scalds, and fire-related injuries. Soak House accepts no liability for injuries or damage resulting from the misuse of the fire pit or from failure to follow safety instructions. Soak House may restrict or prohibit fire pit use at any time for safety reasons, including during adverse weather conditions.

    4.    Hygiene and Attire

    4.1.  All Participants must shower before entering any of the Facilities, including the sauna, ice baths, hot tubs, and plunge pools. This requirement is in place to maintain water quality and hygiene standards for the benefit of all Participants. You must always sit or lie on a personal towel in the sauna and in any other areas where towels are required, as directed by signage or staff instructions.

    4.2.  Appropriate swimwear must be worn in all wet areas at all times. Nudity is strictly prohibited on the Premises. You must remove your shoes before entering any indoor or covered areas, and use the designated shoe racks provided. Running is not permitted anywhere on the Premises, owing to the increased risk of slips and falls on wet surfaces. You must not use essential oils, skincare products, perfumes, or any other substances in the Facilities without prior permission from Soak House staff.

    5.    Prohibited Items and Behaviour

    5.1.  The following items and behaviours are strictly prohibited on the Premises: consumption of alcohol; smoking of any kind, including vaping and e-cigarettes; glass containers of any kind; bringing or using personal electronic devices inside the sauna or in any area where they may be exposed to water or excessive heat, unless expressly permitted; running, horseplay, or any behaviour that may endanger the safety of Participants or staff; and any behaviour that causes unreasonable disturbance, nuisance, or inconvenience to other Participants or staff.

    5.2.  Soak House reserves the right to inspect bags and personal belongings brought onto the Premises where there is reasonable suspicion that prohibited items are present. Any prohibited items discovered may be confiscated and will not be returned. Persons found to be in breach of this Clause may be required to leave the Premises immediately and may be subject to a permanent ban.

    5.3.  You must not take photographs or record video footage of other Participants without their express consent. Soak House reserves the right to require the deletion of any unauthorised photographs or recordings and to remove any person who breaches this provision from the Premises.

    6.     Health and safety

    6.1.  You must not use the Facilities while under the influence of alcohol, drugs, or any other intoxicating substance. If you feel dizzy, faint, short of breath, disoriented, nauseous, unwell, or experience any other adverse symptoms at any time while on the Premises, you must exit the Facilities immediately and seek assistance from Soak House staff or, in an emergency, call 999.

     

    7.    Allergies, Infusions and Complimentary Products

    7.1.  Soak House may from time to time offer complimentary infusions, essential oils, or other products for use by Participants during their Session. By using any such products, you accept full responsibility for any allergic reaction or adverse effect that may result. You must inform Soak House staff of any known allergies before using any complimentary products. If you experience any symptoms of an allergic reaction, including but not limited to difficulty breathing, swelling, eye, nasal, or throat irritation, or skin rash, you must leave the Facility immediately and seek medical attention if necessary.

    7.2.  Soak House does not guarantee that the Premises or Facilities are free from allergens. While we take reasonable steps to minimise allergen exposure, we cannot accept liability for allergic reactions or sensitivities experienced by Participants.

    8.    Personal Property

    8.1.  You are solely responsible for the safety and security of your personal belongings while on the Premises. Soak House, its employees, agents, contractors, and the Host Venue do not accept any liability for the loss, theft, damage, or destruction of personal property, including but not limited to clothing, jewellery, electronic devices, towels, bags, and vehicles, however caused. We strongly recommend that you do not bring valuables onto the Premises. Any storage facilities provided (such as shelving or lockers, where available) are used at your own risk and do not create any bailment or custodial obligation on the part of Soak House.

    1.    Acknowledgment of Risks

    I understand and acknowledge that the use of the Facilities at Soak House (including, but not limited to, wood-fired sauna, ice baths, cold plunges, outdoor showers, ambient plunge, fire pit, and surrounding areas) involves inherent risks, hazards, and dangers, some of which may not be immediately apparent or predictable. These risks include, but are not limited to:

    Heat-related illness, including heat exhaustion, heatstroke, dehydration, and exacerbation of existing medical conditions.

    Burns from contact with hot surfaces, including the sauna stove, stove door, flue, chimney, sauna rocks, and fire guards, as well as burns from steam and hot water.

    Cold shock response, hypothermia, frostnip, and exacerbation of cardiovascular or circulatory conditions arising from the use of ice baths and cold plunges.

    Cardiovascular events, including but not limited to heart attack, stroke, arrhythmia, and changes in blood pressure, which may be triggered or exacerbated by rapid changes between hot and cold environments.

    Slips, trips, and falls on wet, icy, or uneven surfaces, both inside and outside the Facilities.

    Drowning or near-drowning, particularly in ice baths and cold plunge pools.

    Burns, scalds, and fire-related injuries from the fire pit.

    Exposure to allergens, including essential oils, infusions, and environmental allergens.

    Exposure to communicable illnesses from other Participants or from the Facilities.

    Aggravation of pre-existing injuries, conditions, or disabilities.

    I acknowledge that the above list is not exhaustive and that other risks and dangers may exist. I voluntarily assume all such risks, known and unknown, and accept full responsibility for any injury, loss, or damage that may result from my use of the Facilities.

    2.    Medical Declaration

    I confirm that I have read and understood the health and safety information provided by Soak House and set out in its Terms and Conditions. I declare that, to the best of my knowledge and belief, I do not suffer from any of the following conditions unless I have disclosed them in writing to Soak House prior to my Session:

    Epilepsy or any seizure disorder. I understand that persons with epilepsy are prohibited from using the Facilities without exception.

    Recent heart attack, stroke, or any cardiovascular event.

    Known cardiovascular disease, including but not limited to coronary artery disease, heart failure, arrhythmia, or aortic stenosis.

    Uncontrolled high blood pressure (hypertension) or uncontrolled low blood pressure (hypotension).

    Arterial disease or peripheral vascular disease.

    Raynaud's disease or cold urticaria.

    Asthma or other respiratory conditions that may be exacerbated by heat or cold exposure.

    Pregnancy (I understand that I must provide written medical clearance if I am pregnant and wish to use the Facilities).

    Any condition that causes dizziness, fainting, or loss of consciousness.

    Any other medical condition that a healthcare professional has advised may be aggravated by heat exposure, cold exposure, or contrast therapy.

    I confirm that I am not currently under the influence of alcohol, drugs, or any other intoxicating substance. I am not taking any medication that may be affected by heat or cold exposure unless I have disclosed this to Soak House and, where appropriate, obtained medical clearance.

    I understand and agree that it is my sole responsibility to consult with a qualified healthcare professional before using the Facilities if I have any doubt about my fitness to participate. I agree to inform Soak House immediately of any changes to my health status that may affect my ability to use the Facilities safely.

    I authorise Soak House, its staff and representatives to contact emergency services, contact my nominated emergency contact and disclose relevant medical information where reasonably necessary in connection with an actual or suspected medical emergency.

    3.    Assumption of Risk

    I voluntarily choose to use the Facilities at Soak House. I understand and appreciate the risks, hazards, and dangers described in Clause 1 and the health conditions described in Clause 2. I hereby voluntarily and knowingly assume all such risks, including the risk of personal injury, death, or property damage, that may result from my use of the Facilities or my presence on the Premises. I assume these risks entirely on my own behalf and not on behalf of Soak House or any other party.

    I understand that Soak House does not provide medical advice, and that its services are provided for recreational and general wellness purposes only. I am solely responsible for monitoring my own physical condition during my Session and for ceasing activity and seeking assistance if I experience any adverse symptoms.

    4.    Release of Liability

    To the fullest extent permitted by applicable law, I hereby release, waive, and forever discharge Soak House, its owners, directors, employees, agents, contractors, affiliates, and the Host Venue (Canterbury Rugby Club), together with their respective officers, employees, and agents (collectively, the “Released Parties”), from any and all claims, demands, actions, causes of action, liabilities, losses, damages, costs, and expenses (including legal fees and court costs) arising out of or in any way connected with my use of the Facilities or my presence on the Premises.

    This release includes, but is not limited to, claims arising from:

    • the inherent risks of the Facilities, including heat exposure, cold exposure, fire, slips, trips, and falls;

    • equipment failure or malfunction; and

    • the actions or omissions of other Participants.

    For the avoidance of doubt, the Released Parties are not released from any claims arising from their own negligence.

    I understand that this release does not attempt to exclude or limit liability for death or personal injury caused by the negligence of the Released Parties where such exclusion or limitation is prohibited by applicable law, including the Unfair Contract Terms Act 1977 and the Consumer Rights Act 2015. To the extent that any provision of this Waiver is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

    5.    Indemnity

    To the fullest extent permitted by applicable law, I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, actions, liabilities, losses, damages, costs, and expenses (including reasonable legal fees and court costs) arising out of or in connection with: (a) my breach of this Waiver or the Terms and Conditions; (b) my negligent, reckless, or intentional acts or omissions while on the Premises; (c) any injury or damage caused by me to any other person or to the property of any other person while on the Premises; and (d) any misrepresentation I have made in this Waiver or in any other document provided to Soak House.

    This indemnity shall survive the termination or expiration of this Waiver and shall not be affected by any subsequent amendment or variation.

    6.    Safety and Compliance

    I agree to comply with all posted rules, safety instructions, and directions given by Soak House staff while on the Premises. I will not exceed recommended exposure times for the sauna, ice baths, or cold plunges. I will exit the Facilities and seek assistance immediately if I feel dizzy, faint, short of breath, disoriented, nauseous, unwell, or experience any other adverse symptoms. I understand that Soak House may refuse admission or terminate my participation for any health or safety concern, and that no refund is guaranteed in such circumstances.

    I agree to shower before entering any of the Facilities, to wear appropriate swimwear in all wet areas, to sit on a towel in the sauna, and to comply with all hygiene and attire requirements as set out in the Terms and Conditions. I will not run on the Premises, will not bring glass containers, and will not use the Facilities while under the influence of alcohol or drugs.

    7.    Minors and Supervision

    I understand and agree that no person under the age of eighteen (18) years is permitted to use the Facilities unless accompanied at all times by their parent, legal guardian, or a Responsible Adult (a person aged eighteen (18) or over, expressly authorised by the parent or legal guardian to supervise the minor). I further understand that no person under the age of sixteen (16) may use ice baths, cold plunges, or any water maintained at or below fifteen degrees Celsius (15°C), regardless of supervision.

    If I am signing this Waiver on behalf of a minor, I confirm that: (a) I am the parent, legal guardian, or Responsible Adult of the minor named below; (b) I have read and understood this Waiver in its entirety; (c) I accept full responsibility for the minor's safety, conduct, and compliance with all rules and instructions; (d) I agree to indemnify the Released Parties against any claim arising from the minor's use of the Facilities; and (e) I consent to the minor's participation in accordance with the age restrictions and supervision requirements set out above.

    8.    Photography and Publicity

    I acknowledge that Soak House or its representatives may take photographs or record video footage on the Premises for promotional, marketing, or operational purposes. By signing below, I indicate my preference regarding the use of my image (please tick or initial one option):

    ____  I CONSENT to Soak House using photographs and video footage featuring me for promotional and marketing purposes, including on social media, the website, and in printed materials.

    ____  I DO NOT CONSENT to the use of my image for promotional or marketing purposes. I understand that Soak House will make reasonable efforts to exclude me from promotional photography but cannot guarantee complete exclusion in group or wide-angle shots.

    9.    Severability

    If any provision of this Waiver is held by a court or tribunal of competent jurisdiction to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable, and if such modification is not possible, the provision shall be severed.

    10.         Governing Law

    This Waiver shall be governed by and construed in accordance with the laws of England and Wales. I irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising out of or in connection with this Waiver, its subject matter or its formation (including non-contractual disputes or claims).

    ACKNOWLEDGMENT AND SIGNATURE

    I have read and understood this Waiver, Release and Assumption of Risk in its entirety. I understand that by signing this document I am giving up certain legal rights, including rights to bring certain claims in connection with the inherent risks associated with use of the Facilities. I sign this Waiver voluntarily and of my own free will, without any inducement or assurance not stated herein.
